Yeh but it would be a bit annoying becuase noobs would just run aorund instanty killing.
It would be like
*kill* x_x
*kill* x_x
*kill* x_x
*kill* x_x
*kill* x_x
Ok, so if a player attacks another player, they are "stunned" and have a certain amount of time to free themselves from the stun.. if they fail or neglect it, their character dies. The more skilled a player is, the shorter the stun interval, hence the closer the skilled player becomes to having an instant kill ability. Also, the player that is attacked... if they have a high defensive skill level, then the interval of stun will be lengthened... in addition, there could also be the chance that the attack fails completely and the attacked player doesnt even enter a stunned state, but just becomes aware of the enemy.

nah, it'll depend on your stats, and the stats of the person you want to kill. so take it that you have Jack Bauer against Chuck Norris but if you had Jack Bauer he'd kill most whoever was against him if he snuck up against him...too bad he is too badass to consider that an option.

Yeh there should be pre-jutsu that lead up to the instant kill for example;
Garra puts his opponent in sand coffin before crushing them.
if they escape some how before he crushes them then they are safe. if not then garra has his instant kill.
Or
Water nin puts enemy in a whirlpool before sinking them and drowning them.
In order for my example to be understandible I will have to give an instance to where it would happen.
Player A attacks Player B
A random letter appears on both of their screens. Player A presses it first and he gets the instant kill.
Player A then goes off to pwn Player C
A letter flashes on both of their screens, this time Player C is the first to press it and the instant kill is negated, thus alerting Player C to either fight back or run.
